1. Service Provided "As-Is"

FluxCybers and all associated services are provided on an "as-is" and "as-available" basis. We make no warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties regarding the accuracy, completeness, or reliability of any information
• Warranties that the service will be uninterrupted, error-free, or free from viruses
• Warranties that defects will be corrected

Your use of FluxCybers is entirely at your own risk. We expressly disclaim all warranties to the fullest extent permitted by applicable law.

2. Limitation of Liability

This limitation applies whether or not FluxCybers has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such cases, our liability is limited to the maximum extent permitted by law.

Maximum aggregate liability: Our total liability to you for all claims arising from your use of FluxCybers shall not exceed the total amount you paid to FluxCybers in the twelve (12) months immediately preceding the claim giving rise to the liability.

3. User Responsibilities

You are solely and exclusively responsible for:

• All server credentials, SSH keys, API tokens, and access credentials you provide to FluxCybers
• All commands executed through the platform, whether AI-suggested or manually initiated
• All consequences of automated actions on your infrastructure, including data loss, downtime, or security incidents
• Maintaining independent backups and disaster recovery plans for all connected systems
• Ensuring you have proper authorization to connect and manage the servers you add to FluxCybers
• Compliance with your organization's security policies and applicable regulations

FluxCybers acts strictly as an execution tool. You review and approve all execution plans before they run. FluxCybers is not liable for the outcomes of plans you have approved.

4. Indemnification

You agree to indemnify, defend, and hold harmless FluxCybers, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

• Your use of or access to FluxCybers
• Your violation of these Terms & Conditions
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any commands or automation you execute through the platform
• Any claim that content you submitted caused damage to a third party

5. Account Termination

FluxCybers reserves the right, at our sole discretion, to suspend or terminate your account and access to the platform immediately and without notice or refund for any of the following reasons:

• Violation of these Terms & Conditions
• Account sharing or unauthorized access
• Abusive, fraudulent, or illegal use of the platform
• Using FluxCybers to attack, exploit, or compromise third-party systems
• Any conduct that FluxCybers reasonably believes may cause legal liability

Upon termination, your right to use FluxCybers ceases immediately. Provisions that by their nature should survive termination (liability, indemnification, arbitration) shall survive.

6. Dispute Resolution & Arbitration

All disputes arising from or relating to these Terms or your use of FluxCybers shall be resolved through binding individual arbitration, not in court. You expressly waive your right to participate in any class action lawsuit or class-wide arbitration against FluxCybers.

• Arbitration shall be conducted under the rules of a recognized arbitration body
• Each party shall bear its own arbitration costs unless the arbitrator determines otherwise
• The arbitrator's decision shall be final and binding
• This clause does not prevent either party from seeking emergency injunctive relief in court

7. Governing Law

These Terms & Conditions and any disputes arising hereunder shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Both parties submit to the jurisdiction of competent courts for any proceedings not subject to the arbitration clause above.

8. Modifications to Terms

FluxCybers reserves the right to modify these Terms & Conditions at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of FluxCybers after any modifications constitutes your acceptance of the updated terms.

We encourage you to review this page periodically. If you do not agree to the updated terms, you must stop using FluxCybers.

9. Acceptable Use Policy

You agree NOT to use FluxCybers for:

• Any illegal activities or activities that violate applicable laws or regulations
• Attacking, scanning for vulnerabilities in, or exploiting third-party systems without explicit written authorization
• Distributing malware, ransomware, or other malicious code
• Unauthorized access to systems, networks, or data
• Bypassing security controls or authentication mechanisms on systems you do not own
• Any activity that could expose FluxCybers to legal liability

Violation of this policy may result in immediate account termination and referral to appropriate law enforcement authorities.

10. Intellectual Property

FluxCybers and all its content, features, and functionality — including but not limited to software, text, displays, images, and the selection and arrangement thereof — are owned by FluxCybers or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
